Put the Drive Way and the Diesel Tank Right There

Mr Tony and Mrs Helen L*** bought property in Costerfield to set up their retirement retreat. They have built a shed and a garden and put in water tanks, a driveway and a gate. They loved the peace and quiet of the area.

Mr and Mrs L*** appealed Council's approval of the Splitters Creek Facility at VCAT because they were worried about its impacts on their rural residential lifestyle. When the Decision was handed down they accepted it, confident that Council and the regulators would then look after their interests and ensure that they were not disadvantaged or overlooked. As a consequence they neglected to inspect the construction plans for the facility...

Their confidence was misplaced. Look where the crossover entrance for Heavy Vehicles has been placed in relation to their property.

The frontage along Lot 2 spans at least 500m. Was there no other place that this entrance could have been built?

The Planners have decided to build the Heavy Vehicle crossover entrance and Refuelling Station directly opposite and within 30 metres of a residential driveway. The dust from the trucks carting water to Lot 2 pours over the L****'s unmonitored, unsampled property, landing in their garden, on their roof and, from there, into their water tanks.

The L****s  received a single phone call to organise monitoring of their premises, just two days before works recommenced at the site. 

And the noise... always there's noise. But no monitoring.
